1. Introduction to the service
The website feuxdeforet.fr and the ‘Feux de Forêt’ mobile apps (hereinafter the ‘Service’) constitute a participatory platform which, amongst other things, enables:
- to report fires or hazardous situations,
- to view a map of sightings,
- to receive local alerts,
- to help with community moderation of reports.

Under no circumstances does the Service act as a substitute for:
- to the emergency services (e.g. 18, 112),
- nor to the official systems for issuing alerts, providing information to the public or managing bushfires.
2. Acceptance of the Terms and Conditions of Use
Access to and use of the Service imply full and unconditional acceptance of these Terms and Conditions of Use (hereinafter the ‘Terms’).
If you do not accept all or part of the Terms of Use, you must stop using the Service.
The association reserves the right to amend the Terms and Conditions of Use:
- Users will be informed by any appropriate means (banner, notification, email, etc.),
- Continued use of the Service after receiving this notification constitutes acceptance of the new Terms and Conditions.
3. Access to the service
Access to the Service is free of charge, excluding connection and equipment costs, which remain the responsibility of the user.
Some features may require:
- creating a user account,
- enabling location services,
- acceptance of technical settings (notifications, access to the camera, etc.).
The publisher reserves the right, at any time and without prior notice:
- to modify all or part of the Service,
- to suspend or interrupt access to the Service for technical, security or maintenance reasons.
4. User account
Where the creation of an account is required, the user undertakes to:
- to provide accurate, complete and up-to-date information,
- do not impersonate a third party,
- keep their usernames and passwords confidential,
- notify the publisher immediately in the event of unauthorised use of their account.
The publisher may:
- suspend or delete an account in the event of a breach of the Terms of Use, or in the event of misuse or fraudulent use,
- request any further information required to secure the account.
5. How the service works and the nature of the information
The Service relies on voluntary contributions from users.
The information provided via the Service is as follows:
- approximate,
- unofficial,
- which may be inaccurate, incomplete or out of date.
Consequently:
- No guarantee is given as to the accuracy, completeness or timeliness of the reports, maps and alerts,
- the user remains solely responsible for the use they make of the information,
- Users should always give priority to the guidance and information issued by the relevant authorities.
6. User obligations
By using the Service, the user agrees to:
- to provide information exact, sincere and proportionate in view of the situation observed,
- do not publish false alerts or misleading information,
- not to jeopardise public safety or hinder the work of the emergency services,
- to respect professional confidentiality and not to disclose sensitive operational information (ongoing operations, detailed team positions, resources deployed, radio frequencies, etc.) without authorisation from the relevant authorities,
- comply with the legislation in force, in particular with regard to:
- defamation, insulting language, incitement to hatred,
- on the protection of personal data and image rights,
- intellectual property.
In particular, the user must not publish the following via the Service:
- content that is violent, discriminatory, hateful, defamatory or abusive,
- information that enables the precise identification of victims without their consent or without there being a clear need for such information,
- content containing third parties’ personal data (names, telephone numbers, clearly legible number plates, etc.) without a legal basis.
7. Liability for reports and misuse
The user is solely responsible information, data, text, images, videos, audio or any other content that they transmit or publish via the Service.
The following, amongst others, constitute misuse of the Service; this list is not exhaustive:
- false or deliberately exaggerated reports,
- the increasing number of unfounded reports,
- the dissemination of content that is deliberately misleading or alarmist,
- using the Service to harass, threaten or harm others,
- using information from the Service to circumvent security measures or gain access to restricted areas.
In the event of misuse, the publisher may:
- delete or amend the content in question,
- suspend or terminate the user’s access to the Service, either temporarily or permanently,
- where appropriate, pass on the necessary information to the relevant authorities and initiate or support civil or criminal proceedings.
8. Safety, prevention of misuse and technical data
In order to ensure the security of the Service, prevent abuse and combat fraudulent or malicious use, certain technical data may be collected and processed, including:
- IP address,
- the device’s technical identifier (device ID or equivalent),
- log information (dates and times of reports, type of action taken, etc.).
These technical specifications are:
- used for limited purposes relating to security, moderation, the prevention of abuse and the improvement of the Service,
- retained for periods proportionate to the purposes for which they are processed,
- processed in accordance with the applicable data protection regulations (GDPR, the French Data Protection Act).

9. Content moderation
Content published via the Service (reports, comments, photos, videos, etc.) may be subject to moderation:
- by the association’s team,
- and/or by the user community, via reporting or voting features.
The moderation rules applied by the service are set out in the Moderation Policy.
The publisher reserves the right to:
- remove, hide or amend any content that does not comply with the Terms of Use or is clearly unlawful,
- to restrict the visibility of certain content,
- suspend or terminate a user’s access,
- to take these measures on its own initiative or following a report from a third party without prior notice and without any obligation to inform or provide justification to the user concerned..
The publisher is under no obligation to retain or restore deleted content or closed accounts.
10. Intellectual property
10.1. Publisher’s content
All elements comprising the Service (text, interfaces, graphics, logos, maps, data, databases, code, etc.), with the exception of content provided by users or partners, are protected by the applicable intellectual property laws.
Unless prior written authorisation has been obtained from the publisher, the following are prohibited:
- any reproduction, representation, adaptation, translation, distribution, extraction or substantial reuse of the content of the Service,
- any use of the association’s trade marks, logos and other distinctive signs.
10.2. User content
1. Scope of the rights assigned
The sale relates in particular to:
- the right to reproduce the work, in whole or in part, in any medium (print, digital, audiovisual, etc.);
- the right of performance and communication to the public, by any means and on any network (the internet, television, billboards, social media, mobile apps, etc.);
- the right to adapt, modify, translate, incorporate into other works or databases, and combine with other content;
- the right to distribute, make available, hire out or lend;
- more generally, any current or future right of use, whether known or unknown at present, within the limits laid down by the applicable law.
2. Territory
The licence is granted on a worldwide basis.
3. Duration
The licence is granted for the entire statutory term of protection of intellectual property rights, as provided for by French law and the applicable international conventions.
4. Purposes and authorised uses, including commercial uses
The rights granted may be exercised by the association, either directly or through any third party of its choice (partners, licencees, subcontractors, etc.), for any purpose, including:
- the operation, maintenance, development and promotion of the Service;
- measures to prevent, raise awareness of, provide training on and inform the public about wildfires and natural hazards;
- institutional or promotional communications on behalf of the association, in any format;
- the sale or licensing of content to third parties (media organisations, publishers, platforms, research bodies, private companies, etc.), integration of the content into paid products or services (reports, databases, publications, educational materials, etc.), indirect monetisation via advertising, sponsorship or any other business model;
- the resale or licensing of rights to third parties, whether for a fee or free of charge, within the limits of the rights assigned by the user.
5. No financial consideration
The user acknowledges that this assignment is granted without financial consideration and that they shall not be entitled to any remuneration, compensation or share of profits, on any grounds whatsoever, in respect of the use of the content by the association or by third parties to whom the association may have assigned or licensed rights.
6. Moral rights
Where applicable, the user retains their moral rights within the limits provided for by law.
However, to the extent permitted by the relevant legislation, it agrees to:
-that its content may be adapted, cropped, modified, combined or incorporated into other content, media or works, provided that this does not cause disproportionate harm to its honour or reputation;
- not to exercise their right of withdrawal or cancellation in respect of activities already carried out or undertaken by the association or its partners.
11. Personal data
Personal data collected in connection with the Service (for example: email address, location data, technical data, account-related content, etc.) is processed by the association, in its capacity as data controller.
These treatments are carried out, in particular, for:
- to enable the Service to function (account creation, sending alerts, displaying the map, etc.),
- to ensure the security and moderation of content,
- carry out anonymised statistical analyses,
- to comply with legal obligations and respond to requests from the relevant authorities.
Subject to the conditions set out in the applicable regulations, users have the following rights:
- access,
- correction,
- deletion,
- limitation,
- opposition,
- portability, where applicable.
The procedures for exercising these rights, the legal bases for data processing, the retention periods and the recipients of the data are set out in the Privacy Policy available on the website and in the apps.
12. Service availability
The Service is provided ‘as is’ and to the best of the association’s ability.
The publisher does not guarantee:
- continuous and uninterrupted access to the Service,
- the complete absence of errors, bugs or security vulnerabilities,
- the Service’s compatibility with all existing hardware and configurations.
The publisher shall not be held liable, to the extent permitted by law, for:
- any interruption, suspension or malfunction of the Service,
- any loss of data or damage resulting from the improper use of the Service,
- any indirect damage (loss of opportunity, non-pecuniary damage, etc.) resulting from the use of, or the inability to use, the Service.
Nothing in these Terms and Conditions of Use shall exclude or limit the publisher’s liability in the event of personal injury, gross negligence or any other circumstances in which such an exclusion or limitation would be prohibited by law.
13. Liability relating to the user’s information and decisions
Given the participatory and informal nature of the Service:
- The information displayed (reports, maps, comments, etc.) does not constitute advice or an official instruction,
- The user retains full responsibility for their decisions (movements, evacuations, interventions, etc.) and their consequences.
The user undertakes to:
- never deliberately put yourself or others at risk on the basis of information obtained from the Service,
- Follow the instructions issued by the authorities and emergency services, even if they differ from the information displayed in the Service.
14. Third-party links and services
The Service may contain links to third-party websites or services (mapping services, social media, institutional websites, etc.).
The publisher has no control over these third-party websites or services and accepts no liability for:
- their content,
- their practices,
- or their legal compliance.
It is the user’s responsibility to familiarise themselves with the terms and policies applicable to these third-party services.
15. Applicable law and competent court
These Terms and Conditions of Use are governed by the French law.
In the event of a dispute concerning the validity, interpretation or performance of the General Terms and Conditions of Use, and in the absence of an amicable resolution, the dispute shall be brought before the competent French courts, without prejudice to the applicable mandatory provisions relating to consumer protection.
